James Moutsias practises in all areas of commercial and public law. He is readily available for appearance, drafting and advice work.
Civil / Commercial Practice
James has a general commercial practice and has appeared and advised on a wide variety of matters including contractual disputes, property proceedings, industrial and employment disputes, and Australian Consumer Law matters. He also has experience in motor vehicle accident claims.
He has experience in drafting pleadings and affidavits and appears in mediations and hearings in all Courts.
Public Law Practice
James appears in judicial review and merits review proceedings.
He appears in VCAT proceedings relating to Discrimination Law, and has conducted successful matters for applicants in the spheres of education and employment. He has been a part of the teaching team for Discrimination Law at Monash and ACU, and is a member of the Australian Discrimination Law Network.
James accepts briefs to provide advice on a range of public policy and legislative matters.
Criminal Practice
James previously worked at a boutique criminal firm, and as a barrister appeared in a broad range of summary and indictable matters for both prosecution and defence. He now exclusively appears for the prosecution and has an interest in the appellate jurisdiction.
Research and Publications
Prior to coming to the bar, James was a legal academic at Monash University, where he conducted extensive research in administrative law, discrimination law, personal injury and class actions. He also worked as a sessional academic at Deakin and ACU.
He maintains a position as a sessional academic at Monash University as part of the teaching team for Torts, Property and Administrative Law.
James also has a developed understanding of Artificial Intelligence. He previously worked in policy at the Department of Education (Victoria) where he contributed to the Framework for Generative AI in Schools. While working at Monash University, James co-authored a paper on the use and legality of AI in government decision-making.
