John O’Halloran

John is regularly briefed to appear and advise in all Victorian courts and tribunals. His instructors recognise the value of his strategic advice, rigorous attention to detail, and ability to empower clients to make good decisions in litigation.

NOTABLE MATTERS & EXPERTISE:

Some of John’s notable matters since coming to the Bar have included work in:

• Complex business structure disputes: proceedings where assets are held by numerous entities in complex trust relationships, and where a multiplicity of proceedings are instigated (oppression, partnership disputes, breach of trust, breach of fiduciary duties).
• Insurance: trials involving liability and significant questions of expert opinion evidence as to quantum.
• Domestic building and commercial construction disputes: breaches of warranties under building legislation, proportionate liability claims, insurance disputes, contract disputes.
• Family provision claims: acting both for and against estates.
• Real and personal property: claims for equitable interests in real property (e.g., resulting and constructive trusts), caveat removal applications, leasing law, bailment and conversion, and negligent property damage.
   

John’s advisory and paperwork practice is complemented by his forensic and evidentiary skills, developed through his experience as a trial advocate, acting in insurance trials for some of Australia’s largest publicly listed insurers. John is therefore both a meticulous and dynamic trial advocate.

Prior to his call to the Bar, John worked in insurance and employment law. He also enjoys sharing expertise and contributing to professional development. He has presented various seminars on topics such as cryptocurrency and digital assets on death, issues in estates law, and trust deeds.

John graduated from Monash University with a Bachelor of Arts (History) and a Bachelor of Laws (with Honours). He read with David Sanders and his senior mentor was Ian Upjohn CSC KC.
